A notary public is a public official whose powers and duties are defined by statute. A notary acts as an official, unbiased witness to the identity and signature of the person who comes before the notary for a specific purpose. The person may be taking an oath, giving oral or written testimony, or signing or acknowledging his or her signature on a legal document. In each case, the notary attests that certain formalities have been observed.
Does the signer(s) need to be present to have a notarize documents?
Yes, all signers need to be physically present before the notary to get documents notarized through traditional notarizations. If it is a Remote Online Notarization, then all signers would need to be present over video at the same time the signing is taking place.
Remote Online Notarizations are essentially notarizations where a notary and signer(s) are both present by audio and video at the same time when a notarization needs to take place.
There are hundreds of types of documents that need notarizing. Some of the typical documents that frequently require notarizations are:
Real Estate Documents
Power of Attorney documents
Pension and Retirement Documents
Employment Forms
Financial documents
Acknowledgements
Jurat
Affidavits
A Notary is not an attorney unless they are licensed as an attorney in addition to being commissioned by their state as a Notary Public. Someone who is not an attorney cannot provide legal advice. I am a Notary and not an attorney, so I can not provide legal advice. You would need to talk to an attorney to get legal advice on anything.
